Gobind: I put it to you that the reason you did not question Najib in this case is because the police knew for a fact that he was involved in the murder and had no guts to reveal this in their probe.

Deputy Prime Minister Datuk Seri Najib Razak was not questioned in the Altantuya Shaariibuu murder investigations as he was not involved in the case, a police officer told the Sessions court yesterday.
Superintendent Gan Tack Guan, formerly from the Kuala Lumpur Serious Crimes Division, said there was no need to record Najib's statement as investigations had revealed that the deputy prime minister was not involved in the Mongolian woman's murder.
Gan said this was based on the initial murder investigations conducted by the investigating officer Assistant Superintendent Tony Lunggan. "If he (Najib) was not involved, why should he be called in for questioning?" Gan responded during cross-examination by counsel Gobind Singh Deo yesterday.
The police officer was testifying in the trial of blogger Raja Petra Kamarudin who was charged with posting a seditious article titled, Let's send the Altantuya murderers to hell, on his website.
The alleged offence was committed at his house in Bukit Rahman Putra, Sungai Buloh, on April 25. The article also implicated Najib and his wife Datin Seri Rosmah Mansor in Altantuya's murder.
Gan, who is now head of Interpol at the Federal police headquarters in Bukit Aman, is the fifth prosecution witness to take the stand. He is also the complainant in this case. Yesterday, he disagreed with counsel that police did not record Najib's statement as "they had no guts to question the DPM".
Gobind: I put it to you that the reason you did not question Najib in this case is because the police knew for a fact that he was involved in the murder and had no guts to reveal this in their probe.
Gan: I disagree.
He further disagreed that the decision to lodge a police report against Raja Petra was politically motivated.
Gan testified that some of the contents in the alleged article were unfounded, but disagreed when told that the writer was telling the truth when he wrote the article. Judge Rozina Ayob adjourned the case to tomorrow after being informed that Raja Petra was due at the Federal Court today for another matter.

CPO: We used minimal force to disperse the crowd

(The Sun) All but one of the 23 people arrested last night for taking part in a candlelight vigil opposite the Civic Centre on Jalan Yong Shook Lin here were released by 7am today after their statements were recorded.

Those detained included PJ Utara MP Tony Pua, Kampung Tunku assemblyman Lau Weng San, Selangor exco member Ronnie Liu, Malaysiakini.com videographer Syukri Mohammed and Catholic priest Father Paulino Miranda from a church in Shah Alam. Some accused the police of roughing them up.

The arrests have prompted several non-governmental organisations to criticise the police for being heavy-handed although it was a peaceful gathering.

Selangor police chief DCP Datuk Khalid Abu Bakar said the only person still in custody is wanted for a rape case reported in Pahang in 2006.

He said the wanted man, who is in his 30's, has a string of criminal records.

Khalid, who was at the scene, said police had been fair to those at the vigil by first ordering them to disperse about 30 minutes before action was taken.

"The gatherings had been going on for the past four consecutive weekends. Each time we warned them that what they were doing was illegal as they did not have a permit. We took no action except order them to disperse.

"On Sunday, it was the same thing. They dispersed as told but went on to assemble again near the Civic Centre. This is disobedience of the law and as the chief police officer of the state, it is my duty to uphold order in the state."


He said the Light Strike Force (LSF) had to use minimal force when a few resisted arrest.


Khalid said he had to act was there had been complaints by business operators and residents near the Jalan Timur field where the gathering took place.

"If we keep turning a blind eye over such illegal assemblies then it will appear as if this is a state of lawlessness and some people will take advantage of the situation. I have told them to hold such gatherings in a hall or enclosed place but they do not want to. If they did, we will not disturb them, just as how we allowed the Pakatan Rakyat rally at the Kelana Jaya stadium."

Khalid quashed talks of double standards, as even when Umno had wanted to hand over a memorandum to the state secretariat in the past, police were deployed to the scene. He said they however dispersed when ordered to.

Home Minister Datuk Seri Syed Hamid Albar told reporters in Parliament he was only informed about the rally today and will have to check if there was an abuse of power.

"Police work is police work. Their responsibility is to maintain law and order. This is police routine work and if you have done anything that affects the law and order, the police have taken action and if you are not happy with it, you bring it specifically and let me check on it," he said.

Its vice-president Ragunath Kesavan called on police to protect the rights of speech, expression and assembly of all those who legitimately engage in expressing dissent, fairly and without bias.

He said it was alarming that police started dispersing the people as early as a hour before the vigil started and that it was not necessary to use physical force and causing injuries to some participants, as the group was reportedly calm and did not pose any threat to public order.

He also expressed concern that the authorities seem to use the law selectively, breeding notions of bias.

"Several demonstrations over the Pakatan Rakyat government's policies in Penang and Selangor have proceeded without much harrasment nor arrests by the police," he said.

Pua said his shirt was torn as he was grabbed by two police officers, kicked in the stomach by another officer and thrown into the truck although he told them he was the MP for the constituency and that he could walk himself to the truck.

Lau, who nursed a busted lip and scratched face as a result of the arrest, said he was punched in the face by a plainclothes policeman and dragged to the truck when he inquired about the situation of other detainees.


He added he has lodged a police report and requested a medical examination as well as an identification parade because he can remember the police officer clearly.

Lim Kit Siang (DAP-Ipoh Timur) said the incident showed the police have forgotten the recommendation of the Royal Police Commission that the force should become an efficient, professional, incorruptible world-class police service with three priority objectives – to keep crime low, eradicate corruption and respect human rights.

"We are deeply appalled by the unusual manner of the police dispersal of citizens in a peaceful gathering," read the statement.

Orang Asal Walk halted despite clearance from police






• Police stop march for Orang Asli rights

KUALA LUMPUR, Sat - Today marks the first anniversary of the Declaration on the Rights of Indigenous Peoples, adopted by the United Nations General Assembly in 2007. What happened today, ironically, left us with very little wonder why the orang asal in this country have to continue to fight for their rights to exist.

In conjunction with the anniversary, Jaringan Orang Asal SeMalaysia (“JAOS”) has organised exhibitions and workshops from 10 to 14 September 2008 at The Annexe, Central Market to increase awareness on the plight of the indigenous peoples in this country. The height of the 4-day event is the ‘walk’ from Central Market to the Palace to present a memorandum on indigenous peoples’ rights to the King.

The organisers and representatives from various orang asal communities gathered at The Annexe, Central Market as early as 9.30 a.m. in anticipation of the walk. Everyone was in high spirits as participants put on their traditional costumes and carried musical instruments. As they were getting ready to begin the walk, the participants sang the common orang asal song.

Some were seen carrying placards with words such as ‘Jangan Ceroboh Kawasan Orang Asal’, ‘Kami Bukan “Dan Lain-Lain”’, and ‘Hentikan Eksploitasi Hak Kami’. The map to the Palace was also distributed to everyone.

After moving barely a few hundred metres from Central Market, the participants were stopped by the police.

This appeared confusing as yesterday, the police confirmed with the organisers that they have approved the police permit for them to ‘walk’ to the Palace. Despite intense negotiations, the organisers failed to rationalise with the police to allow the walk to go on.

With deep disappointment, the organiser had to inform the participants to return to The Annexe. Some participants showed mild resistance, but being the civic minded lot they are, they obliged the police’s order and walked peacefully back to The Annexe. Along the way, at least one or two representatives of the orang asal were seen giving short interviews to the media protesting the police’s action to stop the ‘walk’.

Rumah pengendali blog popular Malaysia Today pagi ini diserbu polis, dilaporkan berhubung siasatan akuan berkanun seorang doktor Hospital Pusrawi dalam kes liwat yang didakwa membabitkan Datuk Seri Anwar Ibrahim.

Menurut laporan blog itu, sekumpulan polis menggeledah rumahnya dekat Bandar Baru Sungai Buloh mulai jam 8 pagi tadi.


Polis merampas sebuah komputer riba, alat pengimbas dan beberapa dokumen dalam serbuan selama dua jam, laporan itu dipetik.

Blog itu menyebut Raja Petra akan disiasat polis selepas pilihanraya kecil Permatang Pauh pada 26 Ogos ini.

Akuan berkanun doktor hospital swasta itu pertama kali muncul di Malaysia Today pada hari Anwar dituduh di mahkamah, 7 Ogos lalu.

Dalam akuan berkanunnya bertarikh 1 Ogos lalu, Dr Mohamed Osman Abdul Hamid berkata, beliau tetap berpegang kepada hasil pemeriksaannya ke atas Mohd Saiful Bukhari Azlan, pemuda yang mendakwa diliwat oleh Anwar.

Anwar dibawa ke mahkamah sehari selepas Suruhanjaya Pilihan Raya (SPR) mengumumkan tarikh pilihanraya kecil itu yang diadakan selepas kekosongan yang ditinggalkan oleh penyandangannya Datuk Seri Dr Wan Azizah Wan Ismail, isteri Anwar.

Dr Mohamed Osman, yang memeriksa pemuda itu beberapa jam sebelum membuat laporan polis 28 Jun lalu, berkata beliau tetap berpegang dengan hasil pemeriksaannya itu.
Mohd Saiful ke Hospital Pusrawi dan kemudiannya di Hospital Kuala Lumpur sebelum membuat laporan polis, mendakwa diliwat oleh ketua umum PKR.

Di Hospital Pusrawi, Mohd Saiful diperiksa oleh Dr Mohamed Osman.

Dalam laporan perubatannya, yang dibocorkan kepada media, doktor tersebut menyatakan beliau tidak menemui sebarang bukti berlaku liwat.


Dr Mohamed Osman juga mendakwa beberapa perenggan dan perkataan telah ditambah kepada kenyataannya kepada polis berkaitan perkara tersebut.

Sebelum ini, Hospital Pusrawi menyatakan bahawa Dr Mohamad Osman tidak membuat sebarang pemeriksaan berkaitan liwat ke atas Mohd Saiful.

PETALING JAYA: A policemen was arrested after he allegedly raped a 17-year-old girl who was brought into the police station for interrogation.

The girl was allegedly forced to perform oral sex on the policeman, in his 20s, and was raped at a police station in Selangor on June 18.

It is learnt that the girl was on a motorcycle with her boyfriend at 5am when the policeman, who was on patrol, stopped them. As the boyfriend did not have a licence, the policeman and his colleague hauled the couple to the police station for questioning.

Sources said the boyfriend and the girl were questioned in different rooms.

“During questioning, the girl was forced to undress and the policeman threatened to throw her boyfriend in jail for 20 years if she refused to obey him,” said Selangor police chief Deputy Comm Datuk Khalid Abu Bakar.

Fearing for her boyfriend’s safety, the girl agreed to perform oral sex on him before being raped.

After half an hour, the two were released but the girl did not reveal the incident to her boyfriend or family members.

However, two days later she confided in her cousin who promptly told her parents.

Accompanied by family members, the girl lodged a police report at the Putra Heights police station on Sunday.

Khalid said that the policeman, who is married with a child, has been detained and remanded.

“He has been suspended pending investigation,” he added.
